KC Designs - Terms and Conditions

Welcome to KC Designs. These Terms and Conditions ("Terms") govern your use of our website, products, and services. By accessing or using any part of our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.

1. Definitions

• "Client" refers to any individual or entity who engages KC Designs for services.
• "Services" include branding, website design, graphic design, marketing strategy, and related consulting or creative services.
• "Deliverables" refer to final, approved work products submitted to the Client.

2. Scope of Services
We provide creative services as outlined in the agreed-upon proposal or contract. Any modifications must be requested in writing and may be subject to additional fees and timeline adjustments.

3. Payment Terms

• All services are billed according to the pricing structure outlined in the project proposal or on our website.
• A non-refundable deposit is required to begin work.
• Remaining payments are due according to the milestone schedule or upon final delivery, whichever comes first.
• Late payments may incur a late fee of 5% per week until payment is received.

4. Revisions and Approvals

• Most service packages include a set number of revision rounds.
• Additional revisions beyond the scope will incur hourly charges at the current rate ($60/hour).
• Final approval is required from the Client before hand-off or website launch.

5. Intellectual Property

• KC Designs retains ownership of all concepts and materials not selected as final deliverables.
• Upon final payment, the Client receives full usage rights to the final deliverables.
• We reserve the right to showcase completed projects in our portfolio and marketing materials unless otherwise agreed upon.

6. Client Responsibilities

• Clients must provide timely feedback, content, and necessary access (such as domain or hosting credentials).
• Failure to respond within a reasonable timeframe may delay the project and could result in additional fees.

7. Cancellation and Refunds

• If the Client cancels before project completion, payments made up to that point are non-refundable.
• If KC Designs cancels the project, the Client will receive a refund for any work not completed, minus hours already worked.

8. Confidentiality

• Both parties agree to maintain the confidentiality of proprietary information shared during the project.
• NDAs may be signed upon request.

9. Liability and Disclaimers

• KC Designs is not liable for any damages resulting from the use or inability to use the deliverables once transferred.
• We do not guarantee specific business outcomes, such as increased revenue or traffic, though we commit to high-quality professional work.

10. Third-Party Services

• Some services may involve third-party tools (e.g., hosting platforms, payment gateways).
• KC Designs is not responsible for outages, service interruptions, or changes made by third-party vendors.

11. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles.

12. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Continued use of our services after any changes constitutes your acceptance of the new Terms.
